MINUTES OF THE REGULAR ORONO COUNCIL MEETING HELD JANUARY 12, 1987 <br />#1076 KRUEGER CONTINUED <br />Councilmember Goetten questioned the lot width variance <br />in a new subdivision. <br />Assistant Zoning Administrator Gaffron explained that <br />the lot lines were realligned to meet the 200' lot width <br />minimum which was a vast improvement as to the lot width <br />over the prior situation. He noted that the type of <br />reallignment was appropriate given the topography and <br />septic system location. <br />City Attorney Blatz recommended that the drafted <br />resolution be amended to read (Page 2 - #2) "The <br />aforesaid division shall not be filed by the City of <br />Orono with Hennepin County Records Office until such <br />time that the applicant provides documentation that the <br />declaration of private road easement and agreement for <br />maintenance of same has been filed with Hennepin County. <br />She explained that the problem was that the City has no <br />documentation regarding Holly Acres 2nd Addition, <br />therefore does not know the nature of those agreements. <br />In order to protect the City's interest it would be <br />adviseable to have documents refiled for both Holly <br />Acres 1st and 2nd Additions even though it would <br />involve more property owner signatures. <br />Present for this matter were Franklin Groves, 215 <br />Hollander, and Paul Merz, 205 Hollander. Mr. Groves <br />made no comments. Mr. Merz stated he had no problem <br />with City Attorney Blatz's recommendation. Applicant, <br />Ward Krueger, was not present for this matter. <br />Due to Mr. Krueger's absence, Mayor Grabek asked staff <br />if this would be agreeable to Mr. Krueger, suggesting <br />that the matter be tabled for applicant's presence. <br />Assistant Zoning Administrator Gaffron stated that there <br />may be a concern with timing being the next Council <br />meeting is not until February 9, 1987, however, he did <br />not know if Mr. Krueger would be agreeable. <br />In order to protect the City's interest and expedite <br />this matter, City Attorney Blatz recommended inserting <br />language into the resolution such as "documentation of <br />declaration of road easement and maintenance of same <br />signed by necessary parties is filed ", which would give <br />staff the opportunity to review the documents to <br />determine if Holly Acres 2nd Addition has to sign. <br />It was moved by Mayor Grabek, seconded by Councilmember <br />Sime, to adopt Resolution #2109 approving a metes and <br />bounds subdivision of a lot line rearrangement amending <br />the resolution-as recommended by City Attorney Blatz. <br />Motion, Ayes 4, Nays 0. <br />3 <br />
