Page 3 of 3 <br /> and a half story home has an 869 square foot footprint.The applicant is requesting a variance to <br /> allow an 11.7 foot side street setback where a 35-foot setback is required in order to construct a <br /> 28'x 11.5' addition on to the existing home with an 11.5'x 19'second story above. The addition <br /> as proposed will have a partial second story above.The second story portion of the addition will <br /> be set back almost 9 more feet from the road or 20.7 feet. The proposal will be conforming in <br /> hardcover as well as structural coverage limitations. <br /> Practical Difficulties Statement <br /> Applicant has completed the Practical Difficulties Documentation Form attached as Exhibit B, <br /> and should be asked for additional testimony regarding the application. <br /> Practical Difficulties Analysis <br /> In considering applications for variance, the Planning Commission shall consider the effect of <br /> the proposed variance upon the health, safety and welfare of the community, existing and <br /> anticipated tra�c conditions, light and air, danger of fire, risk to the public safety, and the <br /> . effect on values of property in the surrounding area. The Planning Commission shall consider <br /> recommending approval for variances from the literal provisions of the Zoning Code in <br /> instances where their strict enforcement would cause practica/ di�culties because of <br /> circumstances unique to the individua/ property under consideration, and shall recommend <br /> approval only when it is demonstrated ti�at such actions will be in keeping with the spirit and <br /> intent of the Orono Zoning Code. <br /> Staff finds the applicant's request for a side street setback variance may be reasonable <br /> considering there is an additional 22.5± feet between the lot line and Tonkaview Lane totaling <br /> ±35 feet. The applicant's proposed second story will be approximately 9 more feet from the lot <br /> line to reduce any additional massing impacts. - <br /> Issues for Consideration <br /> � 1. Does the Planning Commission find that that the property owner proposes to use the <br /> property in a reasonable manner which is not permitted by an official control? <br /> 2. Does the Planning Commission find that the variances, if granted, will not alter the <br /> essential character of the neighborhood? <br /> 3. Does the Commission find it necessary to impose conditions in order to mitigate the <br /> impacts created by the granting of the requested variances? <br /> 4. Are there any other issues or concerns with this application? <br /> Staff Recommendation <br /> Planning Staff recommends approval of the setback variance as proposed. Fabric or plastic <br /> underlayment should be removed from all landscape areas on the property in order to reduce <br /> hardcover. � <br /> 3 <br />
