#10-3473 RPUD Amendment <br /> June 17,2010 ' � <br /> Page 4 <br /> � Staff recommends the following text amendment of Section78-624,the list of allowed <br /> Conditional Uses in the RPUD District(underlined wording is new text): <br /> � "Sec. 78-624. Conditional uses. <br /> Within the RPUD district,no land or structure shall be used for the following uses except <br /> by conditional use permit: <br /> . <br /> �Public service structures. Public service structures, including but not limited to <br /> electric transmission lines,buildings... (See existing code -no change) ...subject to site <br /> and building plan review pursuant to this division. <br /> (Ord. No. 202 2nd series, § 1(3),2-26-2001) � <br /> (2)Assisted living facilities. Assisted livin�facilities as defined in this Chapter subject <br /> to the �eneral conditions and multifamil ��-specific conditions applicable to uses in the <br /> RPUD District." . <br /> It would also be appropriate to amend the Definitions section of the Zoning Code by adding.a <br /> definition of`Assisted living facilities'. Staff has found that most other area cities have not <br /> adopted a definition of`assisted living facilities', but they still use the terminology of nursing <br /> homes, rest homes, convalescent homes, and the like- see Part 2 of the Definitions Attachment. <br /> As a starting point for discussion purposes, staff would suggest the following definition: <br /> "Sec. 78-1. Definitions. <br /> The following words,terms and phrases,when used in this chapter, sha11 have the <br /> meanings ascribed to them in this section, except where the context clearly indicates a <br /> different meaning. Unless specifically defined in this section,the words and phrases used , <br /> in this chapter sha11 have the meanings given to them in chapter 82. <br /> Assisted living facilities(nursing home rest home) means housing designed for invalid <br /> infirmed, a�ed convalescent or ph s�y or mentallv disabled persons who need <br /> assistance with their dail lY iving needs includin�special support services such as meal <br /> , preparation,housekeepin�personal nursin�care, etc.• but�not including hospitals <br /> clinics, sanitariums or similar institutions, and not includin�residential treatment � <br /> facilities. <br /> Additional Discussion <br /> Platuiing Commission should consider whether there are any specific conditions which should be <br /> applicable to assisted living facilities that would not be applicable to the allowed uses in the <br /> RPUD District, and which should therefore be specifically spelled out for the assisted living use. <br />
