MINUTES OF THE REGULAR ORONO COUNCIL MEETING HELD AUGUST 11, 1986 <br />#1058 COMP. PLAN AMENDMENT CONTINUED <br />Mayor Butler stated that the Fulmer property is not in <br />controversy for re- zoning within the study. She stated <br />that the Fulmers have saved the facility and use. She <br />also noted that MWCC took a great deal of property from <br />the Fulmers when they constructed the interceptor which <br />has complicated their ability to construct any type of <br />sewer system. <br />Councilmember Frahm stated that they should not allow a <br />connection into the system at this point in time as it <br />would set a precedent. <br />Mayor Butler stated that she does not feel there is <br />another case like the Fulmer property. <br />Councilmember Adams stated that he shared Mayor Butler's <br />views in that this is a very unique situation. He asked <br />for the City Attorney's opinion. <br />City Attorney Barrett stated that he has some questions <br />regarding amending the comprehensive plan on case by <br />case applications, but has no firm position at this <br />time. <br />Zoning Administrator Mabusth stated that the Fulmers <br />property fails to meet all standards for a septic system <br />and connection to sewer is the most economical answer <br />and that there is no available land. <br />It was moved by Mayor Butler, seconded by Councilmember <br />Adams, to direct staff to bring back a resolution <br />incorporating the Comprehensive Plan amendment as <br />outlined in staff memo dated July 14, 1986. Motion, <br />Ayes 2, Nays 2. Councilmembers Frahm and Callahan voted <br />nay. <br />Councilmember Callahan stated that he would be open to <br />more consideration in this matter. <br />Councilmember Adams suggested expediting the Fulmer <br />property out of the corridor study. <br />Because of the tie vote, this application will be <br />brought back to the full Council for consideration. <br />12 <br />
