MINUTES OF THE <br /> ORONO PLANNING COMMISSION MEETING <br /> Monday,April 18, 2016 <br /> 6:30 o'clock p.m. <br /> Schoenzeit moved,Thiesse seconded,to table Application No. 16-3824, City of Orono, Zoning Code <br /> Amendment regarding a process to review subdivision exceptions. VOTE: Ayes 5, Nays 0. <br /> 9. #16-3825 CITY OF ORONO,ZONING CODE AMENDMENT TO SECTION 78-1684 <br /> REGARDING THE CALCULATION OF HARDCOVER AND RETAINING WALLS, <br /> 10:35 P.M.— 10:38 P.M. <br /> Barnhart stated in 2012,the City adopted Ordinance 94, governing the regulation of hardcover and <br /> establishing the stormwater quality overlay district throughout the City. Within that ordinance,retaining <br /> walls were defined as hardcover in Section 78-L Currently the City does not allow any hardcover within <br /> the 0-75 foot zone except for deck boxes lifts, landings and/or a stairway to access the lake. <br /> Section 78-1279 states that retaining walls shall not be placed in the shore setback zone. Section 78-1684 <br /> states that retaining walls are hardcover but lists these walls among its standard hardcover exclusions. <br /> During discussion of this item at the wark session,the Council noted that hardcover items in the lake <br /> yard, including boat houses and sheds, have always been included in the hardcover calculation even <br /> though they are not permitted. The draft ordinance codifies practice and confirms Council intent that <br /> retaining walls are not to be included within the hardcover calculation unless within the 0-75 foot zone. <br /> Staff recommends adoption of the ordinance as drafted. <br /> Landgraver commented the draft ordinance has been put together well. <br /> Chair Leskinen opened the public hearing at 10:38 p.m. <br /> There were no public comments regarding this application. <br /> Chair Leskinen closed the public hearing at 10:38 p.m. <br /> Schoenzeit moved,Thiesse seconded,to recommend approval of Application No. 16-3825, City of <br /> Orono,Zoning Code Amendment to Section 78-1684 regarding the calculation of hardcover and <br /> retaining walls. VOTE: Ayes 5,Nays 0. <br /> PLANNING COMMISSION COMMENTS <br /> 10. UPDATE ON CITY COUNCIL MEETINGS SCHEDULED ON MARCH 28, 2016,AND <br /> APRIL 11,2016 <br /> Barnhart reported on the following actions by the City Council: <br /> • The Tufaa application was approved, with Council Members Walsh and Printup opposed. <br /> • The ordinance amendment regulating vacation rentals was tabled and will likely be revisited <br /> sometime in the fall. <br /> • The lighting ardinance was also tabled indefinitely. Some of the Council Members felt the <br /> ordinance was too comprehensive and others felt that it was a good start. <br /> • The application for 3435 Lyric Avenue was approved on Consent. <br /> • The application for 925 Brown Road was approved on Consent. <br /> Page 31 of 32 <br />
