ORONO CITY COUNCIL MEETING <br />MINUTES FOR DECEMBER 13, 1999 <br />( #� #2540 BRADLEY HOYT, 2523 KELLYAVENUE -Continued <br />grant the appropriate approvals. The only way they can do that is by knowing the facts. He <br />said they need to know who the contractor is, the amount of dirt moved, and the condition of <br />the property before, during and after. <br />Sheridan asked what the benefit would be of knowing who the contractor was. <br />Barrett asked if the applicant takes the position that the entire retaining wall was built without <br />moving any dirt on the property. <br />Sheridan said he could not speak to that issue. <br />Barrett said the reason the City would like to see the contract and to speak to the contractor is <br />to find out what he did on the property. <br />Sheridan said that assumes there was a contractor. <br />Barrett said someone moved the rocks and the City would like to know who did that and how <br />much dirt was moved. <br />Sheridan said the City is telling his client that he has done regrading and presumably has done <br />more than ten yards, so why doesn't the City tell them how it was done. • <br />Barrett said the applicant is being asked in good faith to submit the facts which support the <br />application. <br />Jabbour said the City could obtain the aerial photographs from prior years. <br />Sheridan said the City has engineers on its staff and they can give the Council their <br />calculations. <br />Barrett said that does not preclude the City's right to ask the applicant for valuable <br />information in his possession. That is what the City is doing and he asked why the applicant is <br />refusing it. <br />Sheridan said he would let Mr. Skolnick respond. <br />Kelley said if the applicant is not willing to supply the information, he will make a motion for <br />denial at this time. He asked Mr. Sheridan if he is willing to supply the information to the City. <br />Sheridan said the information was supplied with the application. <br />0 <br />Page 8 <br />
