VOTE: Ayes 5, Nays <br />0. <br />( #6) #2522 BANCOR GROUP, INC., SOUTHWEST CORNER OF COUNTY ROAD <br />6 AND WILLOW DRIVE, CLASS III SUBDIVISION, PRELIMINARY PLAT <br />OF WILLOW VIEW <br />This item was continued on the agenda. <br />( #7) #2540 BRADLEY HOYT, 2523 KELLY AVENUE - AFTER - THE -FACT <br />CONDITIONAL USE PERMIT <br />Rick Sheridan, Continental Property, and William Skolnick, Esq., represented the applicant, <br />Mr. Hoyt, regarding an application for a Conditional Use Permit at 2523 Kelly Avenue. <br />Weinberger stated that Mr. Hoyt filed an application for an After- the -Fact Conditional Use <br />Permit. The application is a result of a request made by the City of Orono to bring the <br />property into conformance as there was some work completed on the property without <br />contacting the City about permits to complete some retaining wall work. Staff had told the <br />applicant that the non - permitted work could be remedied by applying for a conditional use <br />permit or he may have to restore the property. Consequently, the applicant agreed to apply for <br />after - the -fact permits which included a conditional use permit and variances for the retaining <br />wall work on the property. Weinberger displayed an existing survey of the conditions on the <br />property. Weinberger said this is Minnetonka lakeshore property on Kelly Avenue. It is a <br />triangular, narrow lot with somewhat of a steep grade from the building area on the property <br />down to the lakeshore. A boulder retaining wall is shown on the current survey. <br />Sometime in September of 1999 Mr. Hoyt requested a conditional use permit application. The <br />application was completed and brought into the City of Orono on October 1. Staff at that time <br />had determined the application for a conditional use permit was incomplete. Staff had <br />requested some additional information that included survey work showing conditions of the <br />property prior to any construction on the lot and also requested surveys and as- builts for the <br />property as the construction was completed. The applicant submitted the current survey on <br />October 29th and stated there was no other information available. Staff had also requested <br />Page 3 <br />
