ORONO CITY COUNCIL MEETING <br />MINUTES FOR JULY 26, 1999 <br />( #2492 Rick and Gail Luzaich, Continued) <br />Peterson stated she is not in support of the plan in that the Applicant's proposal does not <br />restore the shoreline back to its original state. <br />Reznick stated the Applicant is willing to place the trees 25 feet apart, which will accomplish <br />the 90 percent canopy cover, and that this plan will enhance the appearance of the property. <br />Weinberger commented that the trees do fall within the bluff impact zone. <br />Luzaich stated that a majority of the trees that were removed were rotting and split down the <br />middle due to windstorms over the years. <br />Reznick stated that the proposed plan will accomplish a 90 percent canopy cover, which <br />exceeds what existed before they were removed. <br />Mayor Jabbour noted that some:of the neighbors were upset over the removal of the trees. <br />is <br />Reznick suggested that the proposed plan be approved so work can commence on the <br />reforestation of this property, noting that the plan has been revised in accordance with the <br />City forester's recommendations. <br />Mayor Jabbour stated that the City Council is not bound by any recommendations of City • <br />Staff or Planning Commission, noting that the City Council has the final say in this matter. <br />Jabbour commented that the City has an established policy on how these properties should be <br />handled, which needs to be complied with. Jabbour recommended that this matter be tabled. <br />Reznick stated that they are requesting this be approved subject to the appropriate language <br />being worked out with the City Attorney regarding access. <br />Mayor Jabbour commented that the City Council needs to address the reforestation of this <br />property, and that in his opinion the access issue can be worked out with the City Attorney, but <br />that any recommendation of the City Attorney is not binding on this Council. <br />Sansevere remarked that the City Council needs to consider whether approval of this <br />application will set a precedent. <br />Elizabeth Hawn, Planning Commission Representative, stated that the Planning Commission <br />was reluctant to forward this application on without reviewing a revised plan, but that in the <br />interests of time, the Planning Commission wanted this matter acted on before the end of the <br />planting season. <br />Reznick stated he would like the City Council to act on this revised plan, noting that the . <br />10 <br />
