ORONO CITY COUNCIL MEETING <br />MINUTES FOR JUNE 14, 1999 <br />( #9) #2480 SPRING HILL GOLF CLUB, 725 SIXTHAVENUE NORTH -FINAL PLAT • <br />APPROVAL - Continued <br />and saying the trail has been in one spot for ten years, now let's move it in five feet within the <br />ten -foot easement. <br />Jabbour suggested that they try to figure out if the Council could work something out so the <br />golf course could meet their deadline for opening and that the trail issues need to be resolved <br />outside of the Council meeting. <br />Crosby suggested that they try to get as much as possible done by June 25 and to the extent <br />there are open issues, get a bond from Spring Hill. <br />Sansevere asked if there are other issues that need to be addressed to get the course open on <br />time. <br />Crosby said no. <br />Jabbour said they cannot open without a certificate of occupancy and the City cannot issue the <br />certificate. <br />Sansevere asked staff, with the current condition of the trail, what would be a realistic amount <br />of time to expect it to be completed to the Council's satisfaction. • <br />Crosby said the only part that would be difficult to complete is the part on the north side of <br />Co. Rd. 6. <br />Kelley asked if it would have to be bonded, would the City Engineer spec out what it would <br />cost if the City had to complete the project. <br />Jabbour said yes and the City would ask for 150% of the costs. He said the Council should <br />consider not building some of the trail in lieu of the City having the right to build it in the <br />future and the funds be deposited with the Park Commission. <br />Flint wants to stay with the existing trail agreement. <br />Crosby said that the existing trail agreement is not a document that can be filed. It doesn't <br />have legal descriptions or notarizations and it has provisions that have fallen by the wayside. <br />He said it was not his intention to change the agreement, only to take out language that isn't <br />necessary. <br />Crosby said he wants the language regarding an opaque fence from the existing Conditional <br />Use Permit to be used in the trail agreement. <br />Flint said he would agree if the fence will allow the free movement of animals. • <br />Page 16 <br />
