Sweetser (hereinafter "the applicant") on April <br /> 23, 1992 filed a formal subdivision application with the City for approval <br /> of a 2-lot residential plat of property legal ly described as follows: <br /> Refer to Exhibit A, (hereinafter "the property" ) ; and <br /> WHEREAS, after due published and mailed notice in accordance with <br /> Minnesota Statues 462.358 et. seq. and the City of Orono Zoning and <br /> Subdivision Codes, the Orono P lanning Commission held a public hearing on <br /> May 18, 1992 at which time all persons desiring to be heard concerning this <br /> application were given the opportunity to speak thereon; and <br /> WHBREAS, at their regular meeting held on May 26, 1992 the Orono <br /> •City Council considered the subdivision application of the applicant, <br /> noting the fol lowing findings of fact: <br /> 1.. The property is located within the RR-1B Single Family Rural <br /> Residential Zoning District requiring a minimum of 2 acres of <br /> contiguous dry buildable land within each newly created lot. <br /> 2. The property contains a total of approximately 9 acres. 1.5 <br /> acres are designated wetlands. <br /> 3. The proposed plat contains 2 lots each meeting the required 2 <br /> acres of dry contiguous area within each lot as follows: <br /> Lot 1 = 2.6 acres dry contiguous <br /> Lot 2 = 4.75 approximate area of dry contiguous <br /> 4. In an earlier subdivision review, an approved access location for <br /> Lot 2 was confirmed for the 30 m.p.h. roadway. The only access <br /> to the property is limited to a 70+' dry contiguous corridor <br /> along the east side of Lot 2. <br /> 5. Each of the lots have been found to have suitable area for both <br /> principal and alternate on-site sewage treatment systems per the <br /> site evaluation report by Mark S.
