� J . • k <br /> � O� <br /> O O <br /> � � C ITY of ORONO - <br /> � � <br /> ��� �G'�'F RESOLUTION OF THE CITY COUNCIL _ <br /> �kESH�g' NO. 313 4 F <br /> y <br /> CONCLIISIONS, ORD$R AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City <br /> Council hereby grants variances to Municipal Zoning Code Section <br /> 10.22, Subdivision 2 to permit construction of a 22'x26' detached � <br /> garage within the street/rear yard of the property and an after the • <br /> fact variance for structural repairs completed without the benefit of <br /> a building permit to an existing gazebo/bathhouse structure located <br /> within the lakeshore protected area, subject to the following <br /> conditions: <br /> � <br /> 1. Applicant shall apply for a penalty building permit for all ; <br /> work completed for the repair/renovation of gazebo/bathhouse � <br /> structure by June 30, 1992. i <br /> 2. Applicant shall remove 1,105.05 s.f. or 10.53$ of existing ; <br /> hardcover as shown on page 6 of this resolution. Applicant <br /> shall have completed the removal of existing hardcover prior <br /> to the footing inspection for detached garage. <br /> 3. Authorities granted by this variance run with the property <br /> not with the applicant, but are permissive only and must be , <br /> exercised by application for a building permit for the <br /> detached garage within one year of the date of Council <br /> approval, or this variance will expire on that date (June <br /> 22, 1993 ). <br /> 4. Violation of or non-compliance with any of the terms and <br /> conditions of this variance shall constitute a violation of <br /> the zoning code, shal 1 automatically terminate any authority <br /> granted herein, and shall be punishable as a misdemeanor. <br /> 5. The undersigned applicant has read, understood and hereby <br /> agrees to the terms of this resolution and on behalf of <br /> himself, his heirs, successors and assigns, hereby agrees to <br /> the recording of this resolution in the chain of title of <br /> the property. <br /> Page 3 of 6 <br />
