The Orono Planning Commission reviewed this application <br /> on August 17, 1992, and recommended approval of the <br /> proposed variances based upon the following findings: <br /> A. The property is approximately one-third acre in � <br /> area and subject to 2 acre development standards. <br /> c <br /> B. The lot is typical in size of the developed <br /> surrounding Crystal Bay neighborhood properties. <br /> C. A residence has existed on the property since the <br /> early 1940 ' s. <br /> D. The property is served with sewer and has been <br /> assessed a single sewer unit. <br /> 4. The City Council finds that the conditions existing on <br /> this property are peculiar to it and do not apply <br /> • generally to other property in this zoning district; <br /> that granting the variance would not adversely affect <br /> traffic conditions, light, air nor pose a fire hazard <br /> or other danger to neighboring property; would not <br /> merely serve as a convenience to the applicant, but is <br /> necessary to alleviate a demonstrable hardship or <br /> difficulty; is necessary to preserve a substantial <br /> property right of the applicant; and would be in <br /> keeping with the spirit and intent of the Zoning Code <br /> and Comprehensive Plan of the City. <br /> 5. The City Council has considered this application <br /> including the findings and recommendations of the <br /> Planning Commission, reports by City staff, comments by <br /> the applicant and the effect of the variances on the <br /> health, safety and welfare of the community. <br /> CONCLIISIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono <br /> City Council hereby grants variances to Municipal Zoning Code <br /> Section 10.28, Subdivision 5 (B) to permit the construction of a <br /> new residence structure that will require an area variance of <br /> 71,018.4 s.f., 1.63 acres or 81$, a width variance of 170' or <br /> 53.5�, an east side setback variance of 10' or 33.3�, a west side <br /> variance of 13' or 43.3� and a rear setback variance of 31' 6" or. <br /> • 64�.
