The <br /> proposed 193 s.f. detached, one-stall garage is located in the 250'-500' zone. The home <br /> is proposed to have a 25' wide x 15' deep (including stairs) patio on the lake side of the <br /> home, a large, walled planter and a lower patio which is situated almost completely <br /> underneath the home. These features including driveway and sidewalk account for <br /> 28.4% hardcover within the 75' —250' zone. According to hardcover policy the additional <br /> concrete hardcover located near the lake has been applied toward the 75' — 250' zone <br /> resulting in a level of 4,037 s.f. or 29.5% hardcover in this zone. The staircase is <br /> considered allowed hardcover within this area and therefore has not been applied � <br /> toward the 75'-250' zone. <br /> Lot Width Variance ' <br /> The proposed home will meet the required 10' side yard setback on both sides and the <br /> deficiency in lot width has not negatively impacted the site drainage with the size of <br /> home and grading plan as proposed. . <br /> Hardship Statement <br /> Applicant has completed the Hardship Documentation Form attached as Exhibit B, and <br /> should be asked for additional testimony regarding the application. <br /> Hardship Analysis <br /> In considering applications for variance, the Planning Commission shall consider <br /> the effecf of the proposed variance upon the health, safety and welfare of fhe <br /> community, existing and anticipated tra�c conditions, light and air, danger of fire, � <br /> risk to the public safety, and fhe effect on values of property in the surrounding <br /> area. The Planning Commission shall consider recommending approval for <br /> variances from fhe literal provisions of the Zoning Code in instances where fheir <br /> strict enforcement would cause undue hardship because of circumstances unique <br /> to the individual property under consideration, and shall recommend approval <br /> only when it is demons�rated that such actions will be in keeping wifh the spirit <br /> and intenf of the Orono Zoning Code. <br /> 3 <br />
