The City Counci�. has considered this appXication inc�uding <br /> ; the findings and recommendations of the P1.anning Commission, <br /> reports by City staff, comments by the appl.icant and the effect <br /> of the proposed variance on the heal.th, safety and wel.fare of the <br /> community. <br /> 5. The City Council finds that the conditions existing on this <br /> property are peculiar to it and do not appl.y genera�.l.y to other <br /> property in this zoning district; that granting the variance <br /> wouXd not adversel.y affect traffic conditions, light, air nor <br /> pose a fire hazard or other danger to neighboring property; woul.d <br /> not merely serve as a convenience to the applicant, but is <br /> • necessary to alXeviate a demonstrable hardship or difficulty; is <br /> necessary to preserve a substantial. property right of the <br /> applicant; and wouXd be in keeping with the spirit and intent of <br /> � the Zoning Code and Comprehensive Pl.an of the City. <br /> CONCLIISIONS, ORDER AND CONDITIONS <br /> Based upon the above findings, the Orono City Counci� hereby <br /> grants a variance to the MunicipaJ. Zoning Code Section 10.23, <br /> Subdivision 6 (B) to permit the construction of an entryway addition <br /> located 25' from the side 3.ot I.ine where a 30' setback is normal.I.y <br /> required, and grants a variance to Municipal Zoning Code Section <br /> 10.22, Subdivision 2 to al�.ow hardcover of 37.8g in the 75-250' <br /> I.akeshore setback zone where only 25� hardcover is normalXy a1.Yowed, <br /> subject to the foxl.owing conditions: <br /> 1. AppXicant is advised that hardcover on the property in the <br /> 0-75 ' and 75-250�' zones may not exceed the amounts and <br /> percentages as shown on the survey and table attached as Exhibit <br /> B.
