For this reason, storage and <br /> mechanical space will be required on the main and upper levels to re-build a home <br /> with comparable space. <br /> 2) The home has existed as-is since the applicant purchased it. Nothing within the <br /> control of the current owner has created or expanded the hardship for which we are <br /> requesting a variance. . <br /> 3) This variance will not alter the character of the locality,but will assist in improving <br /> . the non-conformities that currently exist on the property through replacement of the <br /> home with a structure which very closely conforms witdi ordinances. <br /> 4) Economic hazdship is not a factor in this application. <br /> 5) This application does not concern matters of sunlight or that of earth sheltered <br /> construction. <br /> 6) Our requested uses are not prohibited under any other sections of the zoning code. <br /> All other requirements are met, or exceeded by our application. . <br /> 7) Not Applicable. <br /> 8) See items#1 and#2 <br /> 9) See items#1 and#2 <br /> 10)Section 462357, Sub section 1 e of the Minnesota state statutes outlines the following . <br /> rights for property owners, and restrictions on local zoning codes. Regarding <br /> Nonconformities it states"(a) Any nonconformity, including the lawful use or <br /> occupation of land or premises existing at the time of the adoption of an additional � <br /> control under this chapter, may be continued,including through repair,replacement, <br /> restoration, maintenance, or improvement,but not including expansion,unless: (1) <br /> the nonconformity or occupancy is discontinued for a period of more than one year" <br /> We believe that we meet the requirements of this section, but are asking for a <br /> variance for re-configuration of existing hardcover which will allow for closer <br /> conformity to zoning requirements, and the elimination of 5 of the 6 current non- <br /> conformities. Our application brings this property much closer to confornuty than <br /> currently exists and cures many existing non-conformities. <br /> 11) It will not. <br /> 12)It does.
