Description of the nroAOSaI: <br /> The property, as it currently stands, does not conform in the following ways: <br /> a): 12.5%hazdcaver in the 0'-75'zone . <br /> b)- House does not meet the 75' lakeside setback <br /> c) Non-conformity with the side yard setback- 3.3' from property line <br /> d) Non-conformity with 75'-250'hardcover requirement <br /> � e) Non-conformity with the adjacent house setback requirement <br /> � Non-conformity with the floodplain requirements, as the lowest level is below <br /> flood plain requirements. <br /> • Our proposal is to remove the existing structure and replace it with a new <br /> home and pool, occupying the same percentage of hardcover as currently <br /> exists. Our proposal cures 5 of the 6 current non-conformities, and leaves the <br /> 6th-hardcover in the 75-250' zone -in balance with the existing hardcover on <br /> the property in the 0-250' zones. <br /> • While the home could conceptually be re-positioned to enable the applicant to <br /> more closely meet the hardcover requirements, an existing sewer easement <br /> prohibits which cuts across the property prohibits the home from being moved <br /> closer to the street, and within the 250'+zone. <br /> • Replacement of this home will also allow for improvement of severe drainage <br /> issues which on the property as a result of improper grading that has been <br /> done on neighboring properties. City staff has indicated that they would allow <br /> grading within the adjacent city-owned fire lane to improve neighborhood <br /> drainage. <br /> � Through this application,we also desire to revise the sewer easement which <br /> was incorrectly drafter when the sewer was installed. The easement is not <br /> centered on the sewer line. <br /> • The pool will become increasingly necessary to the wellbeing of the <br /> homeowner, as she requires physical therapy for a condition caused by a <br /> hereditary gene,HLA-B27, which causes arthritis. To allow their long term <br /> use of the home, it will be required to be built handicapped accessible, one <br /> level design with a shallow pool to be used for physical therapy. <br /> 1) The 1983 flood plain regulations prohibit the remodeling of more than 40% <br /> (cumulative since the ordinance was passed) of a structure that exist within the 100 <br /> year flood zone. It has been estimated that nearly 40% of the value of the home has <br /> already been remodeled through an addition done prior to the current ownership. <br /> Because the crawl space of this home is located below the established flood plain of <br /> 931.5, City Staff has informed us that remodeling the home is not an option. <br /> Additionally,the lakeside setback, adjacent house setback, sewer easement, and <br /> floodplain elevations dictate the location of the proposed new home and restrict the <br /> options that the homeowner has for placing the home across multiple zones of <br /> hardcover. . <br /> RECEEVED <br /> JUN 1 $ 2008 <br /> CITY OF ORONQ <br />
