MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Monday, November 26, 2007 <br />7:00 o'clock p.m. <br />( #07 -3310 Ryan Companies US, Inc., 2765 Wayzata Boulevard West — Continued) <br />possible ramifications of proceeding forward with the project without having the access issue clearly <br />defined. <br />McJilton stated initially the MnDOT people did deny the permit and said that they would like to see a <br />shared driveway arrangement. MnDOT has acknowledged that they do not like the location of the <br />driveway but that in the future the road will belong to the County. The County has indicated they do not <br />have an issue with the new access point. <br />Murphy asked how the County has indicated that. <br />McJilton indicated it is stated in a letter from the County and Staff and MnDOT have been provided <br />1. <br />• <br />with a copy of the letter. McJilton stated they are in the process of working with MnDOT and their <br />neighbors on consolidating access. McJilton indicated they have proceeded forward with some of the <br />building improvements but are delaying work on improvements to the site until the access issue is • <br />resolved. Ryan's intent is to relocate the access and they anticipate doing that work next spring. <br />Murphy recommended that Ryan obtain written documentation from both MnDOT and the County <br />regarding the access. . <br />McJilton stated she does have it in writing from MnDOT that they will issue the permit once they have a <br />shared driveway agreement. <br />White stated the second issue is the ditch work and the amount of.impervious lot coverage. <br />Mattick noted Provision 9B on page seven of the Development Agreement does address the timing of <br />the ditch work. <br />White asked whether that refers to old Highway 12 or the new Highway 12. <br />Turner stated in the Development Agreement the words Highway 12 refer to the new Highway 12 and <br />the words Wayzata Boulevard refer to the current Highway 12. 0 <br />PAGE 4 of 32 <br />
