The <br /> art center building is located over 200' from the fiont property line of North Shore Drive. <br /> The proposed kiln shed will only encroach approximately 20' closer to the road than the <br /> building. The existing building is situated at an angle on the lot and the kiln shed would <br /> not appear to be closer to the street than the existing building. <br /> Conditional Use Permit Analysis <br /> Zoning Ordinance Section 78-916 allows the Planning Coinmission to recommend that <br /> the Council grant a conditional use permit when evidence is submitted to the City making <br /> the following findings: <br /> (1) That the proposed location of the conditional use is in accord with the <br /> objectives of this chapter and the purposes of the district in which the site <br /> is located and the comprehensive municipal plan; <br /> Although varica��ces c�re requested for the location of the accessory <br /> bzcilding related to the location of the principal st�•zcctztr�e, the required SO' <br /> setbacks gove�•ning the coizditional use permit will continue to be met. <br /> (2) That the proposed location of the conditional use and the proposed <br /> condition under which it would be operated or maintained would not be <br /> detrimental to the public health, safety or welfare, or materially injt�rious <br /> to properties or improvements in the vicinity; and <br /> Stcrff finds�zo eviderrce t�h�rt. the proposed addition��ozcld be detrimental to <br /> tlie pzcblic health, safery or��elfa��e, or be mate�°ially injic�°ious to <br /> prope�°ties o�� inzp�•ovenzent in the vici»ity.
