The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission,reports by City Staff, cominents by <br /> the applicant and the effect of the proposed variance on the health,safety and welfare <br /> _ of the community. <br /> . CO�iCLUSIONS, ORDER,AND CONDITTONS <br /> Based upon one or more of the above findings,the Orono City Council hereby grants renewal � <br /> variances to Municipal Zoning Code Section 10.22,Subdivision 2 and Section 10.56,Subdivision 16 <br /> (L) to pemut additions to the existing residence, such construction constitutin�hardcover of 3,888 <br /> s.f. (37.5%) in the 75-250' Iakeshore setback�vhere 5,851 s.f. (56.6%) exists and 25% is allowed, � <br /> and to Section 10.24,Subdivision 5 (B)to permit a residential addition to be setback 8' from the side <br /> property line where 10' is required subject to the follor�vin;conditions: � <br /> 1, The property shall be deyeloped in conformance tivith the site plan dated 2-4-02, <br /> . and most revised on 3-19-02. ' � � <br /> 2. The property owner shall grant a utility easement alon;the south property line for <br /> the sewer. <br /> 3. The final size of the screen porch shall not exceed 350 s.f. � <br /> - 4. Authorities granted by the variances run r�vith the property not with the applicant,but <br /> are permissive only and must be exercised by application for a building permit�vithin <br /> one year of the date of Council approval, or these variances will expire on that date <br /> . Violation of or non-compliance with any of the terms and conditions of the variances <br /> � � shall constitute a violation of the zonin� code, shall automatically terminate any <br /> authority granted herein, and shall be punishable as a misdemeanor. <br /> 6.
