.i �� <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> grants side yard and side street yard setback va.riances and a conditional use permit per <br /> � Orono Municipal Zoning Code Section 78-418 (1) to permit construction of an addition <br /> to the north of the existing building to be located less than 50' from the western side yard <br /> and street yard of Briar Street when 50' is normally required, subject to the following <br /> conditions: <br /> 1. Couilcil approval is based on the site plan submitted by the applicant and <br /> annotated by City staff, attached to this Resolution as Exlubit A. Any <br /> aniendments to the site plan which are not in conformity with City codes will <br /> require fiirther Plaruiing Commissioii and City Council review. <br /> 2. A staff issued pei�nit must be obtained for utilization of a temporary trailer during <br /> constr�tctiori. <br /> 3. Authorities granted by this resolution rLUZ with the property not wi�lz the applicant, <br /> but are permissive only and milst be exercised by obtaining a building permit for <br /> new construction within one year of the date of Council approval, or the variances <br /> and conditional use permit will expire on that date (December 12, 2006). <br /> 4. Violation of or non-compliance with any of the terms and conditions of this <br /> resohrtion shall constitute a violation of the zoning code, shall automatically <br /> terniinate any authority granted herein, and shall be punishable as a misdemeanor. <br /> 5. The Luldersigned applicant has read, understood and hereby agrees to the terms of <br /> tlus resolution and on behalf of the applicant and the applicant's heirs, successors <br /> and assigiis, hereby agrees to the recording of this resolution in the chain of title <br /> of the property. <br /> Page 3 of 5 <br />
