The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission,reports by City Staff, comments by <br /> the applicants and the effect of the proposed variance on the health, safety and <br /> welfare of the community. <br /> CONCLUSIONS, ORDER, AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby grants <br /> variances to Municipal Zoning Code Section 10.23,Subdivision 6(B),Section 10.55,Subdivision 8, <br /> Section 10.22, Subdivision 1 and 2, and Section 10.56, Subdivision 16 (L) (1 and 2)to permit new <br /> residential single family construction on a lot that is 100 feet wide where 200 feet is required, on a <br /> lot that the area is .23 acre where 2 acres is required, a front yard setback to be 13' where 50' is <br /> required,and a lake setback of 50' where 75' is required,a side yard setback to be 28 feet 2 %2 inches <br /> where 30' is required, 919 s.f. of structure within 75' of OHWL where 0 s.f. is allowed, 1,219 s.f. <br /> (16.25%) hardcover in 0-75' setback zone where none is allowed, 760.5 s.f. (30.5%) hardcover in � <br /> 75-250' setback zone where 621.75 s.f. (25%) is allowed. Approval is subject to the following <br /> conditions: <br /> 1. Council approval is based on the site plan submitted by the applicant attached to this <br /> resolution as Exhibit A. Any amendments to the site plan may require further <br /> Planning Commission and City Council review. <br /> 2. Authorities ganted by this variance run with the property not�vith the applicants,but <br /> are permissive only and must be exercised by application for a building permit within <br /> one year of the date of Council approval, or these variances will expire on that date <br /> (Au�ust 12, 2003). <br /> 3. Violation of or non-compliance with any of the terms and conditions of this <br /> variance shall constitute a violation of the zoning code, shall automatically terminate <br /> any authority g�-anted herein, and shall be punishable as a misdemeanor. <br /> Page 3 of 6 <br />
