The City Counci 1 f inds that the conditions existing on <br /> this property are peculiar to it and do not apply generally , <br /> to other property in this zoning district; that granting the <br /> variances would not adversely affect traffic conditions, . <br /> light, air nor pose a fire hazard or other danger to . <br /> neighboring property; would not merely serve as a <br /> convenience to the applicant, but is necessary to alleviate <br /> a demonstrable hardship or difficulty; is necessary to <br /> preserve a substantial property right of the applicant; and , <br /> would be in keeping with the spirit and intent of the Zoning <br /> Code and Comprehensive Plan of the City. : <br /> ;:: <br /> 10. The City Council finds that the expansion of the parking � <br /> area within the lakeshore protected area shall not be . <br /> detrimental to the health, safety or general welfare of the � <br /> public, would not adversely affect light, air nor pose a '� <br /> • fire hazard or other danger to neighboring properties, nor ; <br /> will its use depreciate surrounding property values and that <br /> the proposed level of use of the property will be in keeping <br /> with the intent and objectives of the Zoning Code and <br /> Comprehensive Plan of the City. : <br /> CONCLIISIONS, ORDER AND CONDITIONS , <br /> Based upon one or more of the above findings, the Orono � <br /> City Council hereby grants the variances and conditional us� <br /> permit as set forth above and approves the commercial site plan <br /> date revised by Sathre, Bergquist Inc. and attached <br /> to this resolution as Page 8 of 8 for the Minnetonka Boat Works, � <br /> subject to the following conditions: : <br /> 1. Owner to execute a Developer's Agreement and post a . <br /> Letter of Credit (150� of cost of required improvements) ; <br /> with the City to ensure the following improvements are <br /> fulfilled upon the installation of the expanded parking _ <br /> area: - <br /> A) Drainage/surface water treatment improvements per � <br /> final plans approved by the M.C.W.D. and City of Orono. � <br /> The City Engineer has requested the following F� <br /> amendments to the drainage plan: •• <br /> • i.
