The City Council finds that the proposed re-grading is in accord with the <br /> objectives of the RR-1B zoning district in which the site is located and with the <br /> comprehensive m�nicipal plan and that the proposed land alteration would not <br /> be detrimental to the public health, safety or welfare, or materially injurious to <br /> properties or improvements in the vicinity. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon the above findings, the Orono City Council hereby grants a conditional <br /> use permit for re-grading of the Property in order to prevent erosion onto East Long Lake <br /> Road by leveling the land and installing rain gardens and in order to provide level areas for a <br /> sport court and a water cistern for fire protection, subject to the following conditions: <br /> 1. Council approval is based on the grading plan and the tree replacement plan submitted <br /> by the Owner, attached to this Resolution as Exhibits B and C. Any changes or <br /> amendments to these plans will require further Planning Commission and City <br /> Council review. <br /> 2. Before the project commences, a zoning permit for land alteration and a building <br /> permit for the retaining walls must be obtained from the City and a copy of the <br /> MCWD erosion control permit provided to the City. In conjunction with the City <br /> permits, the Owner will provide an escrow of$2,500 and sign an escrow agreement to <br /> ensure that erosion and sediment control measures are properly maintained, any <br /> required replacement trees are installed, and any damage to public property is <br /> repaired. <br /> 3. Authorities granted by this resolution run with the Property not with the Owner, but <br /> are permissive only and must be exercised by obtaining a land alteration permit and a <br /> retaining wall building permit before August 9, 2011 or grounds will exist for <br /> revocation of the conditional use permit. <br /> 4. Violation of or non-compliance with any of the terms and conditions of this resolution <br /> shall constitute a violation of the zoning code, shall automatically terminate any <br /> authority granted herein, and shall be punishable as a misdemeanor. <br /> Page2of3 <br />
