Description of Request <br /> This requests 1) a variance so that Brad and Cheryl Jones may build a single-family <br /> house their non-conforming lot, as defined by the LR-1A Zoning district and 2) a conditional <br /> use permit so that Brad and Cheryi Jones may move more than 500 cubic yards of fifL <br /> 2. Hardship statement <br /> In November 2004, Brad and Cheryl Jones purchased the lot to build a single-family <br /> residence. To ensure compliance with current ordinances, they demolished the existing <br /> 3 level house, which they understood had been built in 1940. It significantly encroached the <br /> 75' lake setback. They also demolished the non-conforming lakeside boat house, and removed <br /> all non-conforming patios and retaining walls within the 75' lake setback. Public sanitary <br /> sewer services the lot. <br /> The lot is zoned LR-1A, which requires a two-acre, 200-foot width minimum lot size. <br /> The lot is about 1.5 acres and 142 feet wide. Moreover, the lot includes approximately <br /> 26,500 square foot of wetlands. The buildable area of the lot is therefore slightly less than <br /> one acre, without regard to various setbacks. If the Wetland occupying this lot were only <br /> 1,900 square feet smaller, the Jones' application for a building permit would not require a <br /> variance but would meet the requirements for administrative approval of a request for a <br /> building permit. <br /> The Joneses cannot cure the non-conformity by adding adjacent property to their lot. <br /> The lots on both sides are owner-occupied residences. The adjoining landowners want to <br /> keep their property intact. The Joneses are not able to purchase property from either <br /> neighbor in order to satisfy the minimum requirements of this zoning district. <br /> Building a house on this site is consistent with its prior use, as a residence for much of <br /> the 20th Century. The Joneses have spoken to the neighbors and shown them the site plans <br /> and the drawings of the proposed house. The neighbors do not oppose the proposed <br /> construction. <br /> In addition, this lot has unique and difficult topography. The entrance to the property is <br /> from the northeast. The lake is to the southwest. The wetlands occupy most of the <br /> northeast side of the property.
