Lot area variance to perinit coizstruction of a new residence on an existing lot 0.64 <br /> acres in area when 1.0 acres is normally required. <br /> 2. Lot width variance to permit construction of a iiew residence on an existing lot <br /> 66' in width at the shoreline and 70' in width at the 75' setback when 140' in <br /> width is normally required. <br /> 3. Conditional use ernzit to allow retaining walls and gradin witlun 5' of a lot line. <br /> St�ff Recommendation: Staff recoinmends approval of the requested lot area and width <br /> variances, however would recommend denial of the conditional use pernlit to allow <br /> retaining walls and grading within 5' of the lot line. Staff's position is the potential <br /> safety and maintenance issues involving a retaining wall of the height proposed and its <br /> placement directly along the property line. <br /> Pertinent Zoning Ordinance Sections <br /> Sec. 78-330. Area, height, lot width and yard requirements. <br /> (b) Lots. (b) Such grading and earth movement shall be subject to <br /> approval by the building iizspector at the tinle of issuance of a building permit, provided <br /> that a plan showing proper drainage and protection of adjoining property has been <br /> submitted. Where sucli earth movement is not being performed in conjunction with a <br /> building permit, a separate land alteration permit shall be required. Any tulusual land <br /> alterations, including earth filling, removal or grading, proposed by a builder shall be <br /> subject to a coiiditional use permit as provided for in this chapter. The following land <br /> alterations shall be considered as unusual land alterations: (3) Grading or alterations <br /> that would propose any changes in elevations within five feet of adjacent residential lot <br />
