`� `�x�:'- . <br /> � _ � ,�- c�t� o� oR,oNo . <br /> � � f �� <br /> �" � zT" RESOLUTION OF THE CITY COUNCIL <br /> �z t .' <br /> � � NO. 2604 <br /> • � • • <br /> A RESOLOTION GRANTING <br /> VARIANC$S TO <br /> MUNICIPAL ZONING CODE <br /> SECTIONS 10.55, SIIBDIVISION 8 AND <br /> 10.22, SIIBDIVISIONS 1 & 2, <br /> AND A CONDITIONAL OSE PERMIT PER <br /> SECTION 10.55, SIIBDIVISIONS 9 & 10 <br /> FILE #1364 <br /> WHEREAS, Edwin Gage (hereinafter "the applicant") is the owner <br /> of the property located at 480 Tonkawa Road within the City of Orono <br /> (hereinafter "City") and legally described as follows: <br /> Tract A, Registered Land Survey No. 1305, Hennepin County, Minnesota <br /> (hereinafter "the property); and <br /> WHEREAS, the applicant has made application to the City of Orono <br /> • to permit construction of an elevated walkway within the 0-75' lakeshore <br /> setback zone, requiring variances to Municipal Zoning Code Sections 10.55, <br /> Subdivision 8 and 10.22, Subdivisions 1 & 2 which disallow structures and <br /> hardcover within the 0-75' setback zone, and a conditional use permit per <br /> Section 10.55, Subdivisions 9 & 10 for construction of permanent structures <br /> within the f loodway and f lood fringe districts. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> l. This applicatian was reviewed as Zoning File #1364. <br /> 2. The progerty is located in the LR-1B Single Family Lakeshore <br /> Residential Zoning District. <br /> 3. The property is approximately 5 acres in area. <br /> 4. The applicant's proposal included a walkway platform width of 6' <br /> . in the 0-75' lakeshore setback zone. Past City Councils have as a <br /> matter of policy waived the variance requirements for such access <br /> structures which do not exceed 4' in p latform width, and have allowed <br /> such structures to be permitted by City staff. <br /> • 5. The Orono Planning Commission reviewed this application on January <br /> 17, 1989, and recommended on a vote of 4-3 to approve the proposed <br /> variances and conditional use permit for the 6' wide walkway structure <br /> based upon the fol lowing findings: <br /> Page 1 of 5 <br />
