City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 2512 <br />A RESOLUTION GRANTING PRELIMINARY APPROVAL <br />OF THE PLAT OF MOELLER'S ADDITION <br />APPLICATION NO. 1331 <br />WHEREAS, the Metropolitan Waste Control Commission hereinafter <br />"applicant", on August 25, 1988 filed a Class II subdivision application <br />with the City of Orono, hereinafter "City", for approval of a two lot plat <br />of a property legally described on Exhibit A, attached to this resolution <br />and hereinafter referred to as "property"; and <br />WHEREAS, after due published and mailed notice in accordance with <br />Minnesota Statues 462.358 et. seq. and the City of Orono Zoning and <br />Subdivision Codes, the Orono Planning Commission held a public hearing on <br />October 3, 1988, at which time all persons desiring to be heard concerning <br />this application were given the opportunity to speak thereon; and <br />WHEREAS, at their regular meeting held on October 10, 1988, the <br />Orono City Council considered the subdivision application of the applicant, <br />noting the following findings of fact: <br />1. The property is located within the LR -1C-1 Lakeshore Residential <br />Sub -district requiring a minimum of 1/2 acre. 4 <br />2. The property contains a total of approximately 31,177 s.f. or .71 <br />acres. Lot 1 consists of 28,083 s.f. and Outlot A equals 3,099 s.f. <br />3. outlot A is intended only for public utility purposes by the <br />applicant and is not intended for residential development. The <br />approved use of this outiot will hereafter be restricted by an <br />appropriate restrictive covenant filed against the chain of title of <br />the outlot. <br />4. Access to existing properties and the outlot shall remain via the <br />existing private drive along the west boundary of the property. <br />5. A single family residence already exists on Lot 1 and is not <br />intended for new residential construction at this time. <br />6. The existing residence on the lot meets the required setback from <br />the proposed shared lot lines. <br />NOW, THEREFORE BE IT RESOLVED, that based upon either one or more <br />of the findings noted above, the City Council of the City of Orono hereby <br />•approves the preliminary plat application for the Metropolitan Waste <br />Control Commission per plat drawings by Ernest G. Rud of E.G. Rud & Sons, <br />Inc., Land Surveyors, dated July 19, 1988, and further grants a variance to <br />the continued use of a private driveway for access to the newly created <br />outlot and existing residential lots, subject to the following conditions: <br />Page 1 pf 3 <br />
