MINUTES OF THE <br /> ORONO PLANNING COMMISSION MEETING <br /> - Monday, March 15, 2004 <br /> 6:00 o'clock p.m. <br /> (#9. #04-2992 RON POTAS, 2190 SHADYWOOD ROAD VARIANCES-Continued) <br /> Applicant inquired whether the motion included his ability to re-side the garage located near the <br /> street. Chair Smith indicated the applicant doesn't need commission approval and just needs to <br /> put that information into the building permit request. <br /> 10. #04-2993 CHRIS VALERIUS, 2377 SHADYWOOD ROAD,VARIANCES FOR A <br /> COFFEE SHOP (8:51-9:30 P.M.) <br /> Chris Valerius, the applicant and her husband, was present. <br /> Gundlach explained the applicant is proposing to convert the existing residence located at 2377 <br /> Shadywood Road to a coffee shop with bakery and restaurant type uses. The current residence is <br /> a non-conforming use as the property is zoned B-1, Retail Sales District. The applicant's <br /> proposed use, although conditional, is a conforming use of the B — 1 district. As noted in Exhibit <br /> C, the applicant is an experienced business owner that has operated coffee shops in the Cities of <br /> Long Lake and Mound. <br /> Gundlach continued stating that the applicant is proposing several improvements to allow her to <br /> conduct business at this site, the major ones being conversion of a residential home into a <br /> commercial business (requiring a building permit), a 20' x 32' (640 s.f.) addition to the existing <br /> structure (requiring a building permit), and a drive-through facility. The other improvements <br /> proposed are landscaping, removal of the existing, non-conforming shed and screened porch, the <br /> addition of a grade level deck (requiring a building permit), construction of parking stalls and <br /> interior changes to accommodate a commercial business (requiring a building permit). As noted, <br /> many of these improvements require a building permit that in turn requires a commercial site <br /> plan review. The purpose of a commercial site plan review is to allow the City to complete a <br /> comprehensive review of the site in an effort to bring it closer to conformance. <br /> Gundlach indicated the applicant is proposing a building addition to follow the same setback on <br /> the north side of the lot(along Lyric Avenue) as the existing structure. The existing structure is <br /> non-conforming at this setback with a setback of 24' when 35' is required. To extend this line of <br /> the building, a side street setback variance is required. The existing shed and screened porch, <br /> also within the required yards, will be removed bringing this side of the lot somewhat more <br /> towards conformance. <br /> Gundlach continued that the applicant has proposed a drive through and parking stalls in the rear <br /> of the property. The Zoning Ordinance requires an unobstructed rear yard of 30 feet. This <br /> includes all pavements for parking, drive isles, and sidewalks. With the applicant's proposal a <br /> rear and north side yard parking variance is required to accomplish the drive-through and parking <br /> stalls shown on the submitted survey. <br /> Page 23 of 48 <br />
