Staff responded that the road is difficult to park on and get in and out and <br /> that the driveway is not excessive in size. <br /> Mabusth stated this is a hardship lot. It has the 0-75' on both sides indicating a peninsula. <br /> Rahn stated that no steps should go into the 0-75' so steps should be on the side of the house. <br /> Mabusth noted there is no hardcover in the yard and as long as the deck part is removed it is zero <br /> percent in the 0'-75' zone. <br /> Bremer asked applicant what they think about reducing the deck to 1963 size. <br /> Applicant said they wish to keep the deck large enough to place one or two chairs because as <br /> people get older they are not as active getting around. Applicant stated they had no problem in <br /> reducing the deck to meet the 75' setback including steps to the side. <br /> Rahn stated he would be satisfied with a 50 square foot deck or 5' x 10',big enough for two <br /> chairs. <br /> Applicant again asked for 5' x 12' deck. <br /> Chair Smith asked staff to sketch on the plan what that size deck would look like— a grade level <br /> deck that would not extend into the 0'-75' setback with steps to the side. Steps that extend <br /> toward the lakeside but do not extend into the 0-75' would be approved as well as long as the <br /> deck is not made any wider. <br /> Mabusth moved and Chair Smith seconded to approve the after-the-fact variance <br /> application for#05-2982 for Claryce and Lyle Johnson, 1398 Rest Point Road allowing the <br /> existing deck to be altered to a 5' x 12' dimension, stairs to be constructed towards the lake <br /> side but not extending into the 0'-75' setback area and be three feet in width. VOTE: Ayes: <br /> 7 nays 0. <br /> 5. #04-2988 SEAN AND LEAH DALEY, 605 PARK LANE, AFTER-THE-FACT <br /> VARIANCE (7:24—7:43 P.M.) <br /> The applicants are requesting the following variances: <br /> 1. After-the-fact hardcover variance within the 75'-250' zone to allow 58.2%hardcover where <br /> 25% is allowed and 52.2%was previously approved. <br /> 2. After-the-fact side yard setback variance in order to allow the newly constructed deck to <br /> remain at 4.2' from the side lot line where 10' is required and the home is setback 3.2'. <br /> Page 10 of 48 <br />
