MINUTES OF THE <br /> ORONO PLANNING COMMISSION MEETING <br /> Tuesday, January 20, 2004 <br /> 6:00 o'clock p.m. <br /> (#04-2967 SHARON RAE GUIMOND, 2900 WATERTOWN ROAD, <br /> CONDITIONAL USE PERMIT AND VARIANCE—Continued) <br /> reported that, in June of 2003, a 2,616 s.f. barn on the property was destroyed by arson. <br /> The applicant is requesting a variance from the Oversized Accessory Structure limit to <br /> replace the barn that was destroyed with a 1,500 s.f. barn. The maximum size for an <br /> oversized accessory structure on a 2 acre lot is 1,200 s.f. Additionally, the nature of the <br /> property is a through-lot. Accessory structures constructed on through-lots are a <br /> conditional use. The purpose of the conditional use permit in this instance is to assure <br /> minimal visual impact on neighboring properties and views from the road. <br /> Curtis indicated that the Planning Department Staff recommends approval of the variance <br /> and conditional use permit as requested with the following provisions: <br /> 1. Density of the vegetation on the lot is to be kept such that the visual impact from Wear <br /> Circle is minimized. <br /> 2. No access to Wear Circle for proposed barn. <br /> Hardship: Staff finds a hardship exists in that the situation which destroyed the barn was a <br /> situation not created by the applicant. <br /> Ms. Guimond stated that it is her wish to replace the barn that had burned down with a <br /> smaller,but similar, style barn garage. <br /> Acting Chair Mabusth asked how large the original barn had been. <br /> Curtis indicated that the original barn had been 2600 s.f. and 40' tall. <br /> Hawn recommended the applicant remove some of the cement and remaining damaged <br /> property from the fire. <br /> Guimond stated that these would be removed with the new construction. She indicated that <br /> she would like to retain the barn look and roof line. <br /> There were no public comments. <br /> Fritzler maintained that the applicant could reuse the original concrete slab and reduce the <br /> size of the structure to 1200 s.f. and still have a barn style building. <br /> Hannaford pointed out that the original structure was almost twice as large as what was <br /> being proposed. <br /> Hawn moved,Acting Chair Mabusth seconded, to recommend approval of <br /> Application#04-2967, Sharon Rae Guimond,2900 Watertown Road, granting <br /> approval of the variance and conditional use permit as requested with the following <br /> provisions: Density of the vegetation on the lot is to be kept such that the visual <br /> PAGE 15 of 53 <br />
