MINUTES OF THE <br /> ORONO PLANNING COMMISSION MEETING <br /> Monday,May 16,2005 <br /> 6:00 o'clock p.m. <br /> (#05-3111 Water Street Homes,Continued) <br /> Carlson stated animals and lawn fertilizers are more detrimental to wetlands than the proposed use of this <br /> structure. Carlson indicated they are agreeable to installing a holding tank to address the concerns about <br /> the drainage into the septic system. <br /> Carlson noted he had to design a building that would allow storage of the vehicles as well as access and <br /> that there are not issues with hardcover. <br /> Carlson stated given the wetlands and the location of the building pad, they are restricted to constructing <br /> the structure in front of the principal residence. <br /> Jurgens indicated he does not see a hardship for the oversized structure. <br /> Bremer commented she views the topography of the lot a hardship. <br /> Fritzler stated in his opinion if the statutory definition of hardship is used,there is not a hardship. <br /> Winkey moved,Kempf seconded,to recommend approval of Application#05-3111,Water Street <br /> Homes,LLC,granting of a variance for an accessory structure located nearer the front or street lot <br /> line than the principal residence structure, a variance to the allowed footprint for an oversize <br /> accessory structure,and a conditional use permit for plumbing in an accessory structure for the <br /> property located at 2260 Fox Street. <br /> Bremer suggested amending the motion to include a covenant limiting the future use of this structure, <br /> installation of a holding tank for the car wash, and confirmation that the wetland moratorium does not <br /> apply to this property. <br /> Winkey amended his motion,Kempf seconded,to include a covenant restricting the future use of <br /> the accessory structure,the installation of a holding tank for the car wash,and confirmation that <br /> the wetland moratorium does not apply to this property. VOTE: Ayes 4,Nays 2,Fritzler and <br /> Jurgens opposed. <br /> 8. #05-3112 LOREN AND STACEY SCHOENZEIT,4480 FOREST LAKE LANDING,LOT <br /> LINE REARRANGEMENT AND VARIANCES, 10:07 P.M.— 10:58 P.M. <br /> Loren and Stacey Schoenzeit, Applicants,were present. <br /> Gundlach stated the applicants are requesting the following variances in order to construct additions onto <br /> the existing footprint and to remodel the existing residence: <br /> 1. Lot line rearrangement with 1090 Wildhurst Trail whereby a land exchange would result in two <br /> non-conforming area and width lots to remain non-conforming in area and width. <br /> PAGE 25 <br />
