NO. <br /> .� �,.� • <br /> • A RRSOLIITYON GRANTING <br /> � A VARIANCE TO <br /> MONICIPAL ZONING CODB <br /> SECTIOA 10.22, SDBDIVISION 2 <br /> FILS #1308 <br /> WHER$�,S, Robert Owens (hereinafter "the applicant") is the owner <br /> of the property located at 1700 Bohn's Point Road within the City of Orono <br /> (hereinafter "City") and legally described as follows: <br /> Exhibit A, attached, (hereinafter "the property"); and <br /> wHERB,AS, the applicant has applied to the City for a variance to <br /> Municipal Zoning Code Section 10.22 , Subdivision 2 to permit the <br /> replacement of an existing deck which contributes to hardcover. in the 75- <br /> 250' lakeshore zone in excess of the 25$ hardcover normally al lowed. <br /> ,y • NOW, _TS$REFORL, B$ IT R$SOLV$D by the City Council of Orono, <br /> _, <br /> ; Minnesota: � <br /> � FINDINGS <br /> :..� <br /> ..� 1. This application was reviewed as Zoning File �1308. <br /> �� 2. The property is located in the LR-1B Single Family Lakeshore <br /> ;�� Residential Zoning District. <br /> •� <br /> ' ? 3. The Orono Planning Commission reviewed this application on July <br /> ��s 18, 1988, and recommended approval of the proposed variance based upon <br /> �:°; the following findings: <br /> '.1 <br /> l'% A) During the necessary dismantling of the previously existing <br /> �`� deck stairway in order to make repairs to the lakeshore bank <br /> :j which was damaged during the 1987 super-storm, it was found that <br /> `�� the pre-existing deck was infested with carpenter ants and was no <br /> longer safe for use. The applicant's contractor subsequently <br /> ;�� designed a replacement deck of similar square footage and <br /> �' slightly different shape and commenced construction without the <br /> -' required permit. <br /> v • , <br /> � B) The replacement deck comprises of approximately 400 s.f. of <br /> *.. <br /> hardcover and is located 90' from the lakeshore, 10' from the <br /> ;� • side lot line, and behind the average lakeshore setback line. <br /> The only variance needed for approval of this deck is for <br /> hardcover in the 75-250' zone. <br /> �^Y'� • ' Page 1 of 4 <br /> . <br /> ,� <br />
