The City Council has considered this application inc].uding the <br /> findings and recommendations of the Planning Commission, reports by <br /> City staff, comments by the applicant and the effect of the proposed <br /> variance on the health, safety and welfare of the community. <br /> f. The City Council finds that the conditions existing on this <br /> property are peculiar` to it and do not apply generally to other <br /> property in this zoning district; that granting the variance would not <br /> adversely affect traffic conditions, light, air nor pose a fire hazard <br /> or other danger to neighboring property; would not merely serve as a <br /> convenience to the applicant, but is necessary to alleviate a demon- <br /> strable hardship or difficulty; is necessary to preserve a substantial <br /> property right of the applicant; and would be in keeping with the <br /> sp.irit and intent of the Zoning Code and Comprehensive Plan of the <br /> ' City. <br />�� . <br /> f CONCLIISIONS, ORDffit AND CONDITIONS <br /> i •; Based upon one or more of the findings noted above, the Orono <br /> � City Council hereby grants a variance per Municipal Zoning Code Section <br /> • 10.22, 5ubdivision 1 (B) to permit the construction of a deck which will <br /> encroach p:ast the average lakeshore setback line, and a variance to Section <br /> 10.22, Subdivision 2 to allow hardcover of 34.9� in the 75-250' zone where <br /> � only 25� hardcover is normally allowed, subject to the following <br /> �j conditions: <br /> � <br /> 1. Hardcover on the property is allowed as follows: <br /> 0-75 ' = 18 s.f. tie border around flower bed (0.2$) <br /> 75-250' (area within zone = 12,872 s.f. ) : <br /> House 1,711 s.f. <br /> � Front Stoop 84 s.f. , <br /> ; Garage Apron 48 s.f. <br /> � Patio 504 s.f. <br /> � Driveway 1,617 s.f. <br /> t Deck 528 s.f. <br /> ; ___-________ <br /> � TOT�,L 4,492 s.f. (34.9�) <br /> ` 2. Applicant shall remove areas of hardcover as shown on Exhibit A, <br /> � prior to final inspection of deck.
