, - . <br /> � <br /> , ; � <br /> . <br /> }:,��:, d � Cit of ORONO <br /> ��{�� � <br /> • �`�'�V�' RESOLUTION OF THE CITY COUNCIL <br /> Y�� � <br /> ���, �`� NO. 2464 <br /> ` • � • • <br /> y A R$SOLIITION GRANTING <br /> A VARIANC$ TO <br /> MUNICIPAL ZONING CODE <br /> SECTION 10.22, SDBDIVISIONS 1 & 2 <br /> , FILB #1278 , <br /> WH$R$AS, Ronald Timm (hereinafter "the applicant") is the owner <br /> of the property located at 4496 North Shore Drive within the City of Orono <br /> (hereinafter "City") and legally described as follows: <br /> Lots 1 and 2, "Berquist's Second Addition to Saga Hill", Hennepin <br /> County, Minnesota (hereinafter "the property"); and <br /> WHEREAS, the applicant has applied to the City for a variance to <br /> Municipal Zoning Code Section 10.22, Subdivision 1 (B) to construct a deck <br /> which will encroach into the average lakeshore setback where no <br /> encroachment is normally allowed, and a variance to Section 10.22, <br /> Subdivision 2 to permit the addition of structural hardcover in excess of <br />� • 25$ in the 75-250' setback zone where only 25$ hardcover is normal•ly <br />;) allowed. r <br /> � • NOW, TH$REFOR$, B$ IT RBSOLV}3D by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File #1278. <br />;� 2. The property is located in the LR-1B Single Family Lakeshore <br /> ;; <br /> Residential Zoning District. <br /> - 3. The Orono Planning Commission reviewed this application on June <br /> 20, 1988, and recommended approval of the proposed variance based upon <br />'� the following findings: <br />•� A) The proposed deck is at or below grade level of the adjacent <br /> � affected house, hence no lake views currently enjoyed by the <br /> J neighboring property owner will be encroached upon. <br /> ? B) The proposed deck is entirely within the 75-250' setback <br /> � zone. The applicant has agreed to remove existing areas of non- <br /> � structural hardcover which wil 1 reduce the 75-250' hardcover on <br />,.� the property from 43.9� to 38.2$, a net decrease of hardcover on <br /> • the property of more than 700 s.f. <br /> 4.
