MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />MONDAY, JULY 24, 2000 <br />0 <br />(JAMES ANDERST, Continued) <br />Anderst stated the building is not changing except for the four foot expansion to the restroom <br />area. Anderst commented he is merely expanding into existing space. <br />Mayor Jabbour stated in his view the Applicant is entitled to proceed forward with his remodeling <br />project. <br />Anderst stated the improvements have enhanced the neighborhood. <br />Mayor Jabbour stated the Applicant will be required to meet certain conditions at the time the <br />site plan and conditional use permit process are reviewed. <br />Weinberger stated the City Council will need to approve the Applicant proceeding forward with <br />the remodeling project, noting the building currently is open and construction is underway. <br />Flint commented since the Applicant is in the midst of the remodeling at the present time, it is <br />difficult for the City Council to tell the Applicant not to proceed forward since City Staff failed <br />to inform the Applicant of the proper procedure that needs to be followed. Flint reiterated the <br />applicant will be required to meet certain conditions that are normally required as part of the <br />conditional use permit. <br />Flint moved, Jabbour seconded, to approve the continued remodeling of the Narrows <br />Saloon located at 3380 Shoreline Drive prior to the August 21, 2000 Conditional Use Permit • <br />review and prior to the Conditional Use Permit being issued by the City of Orono, with <br />the understanding the Applicant will be required to meet certain required conditions as <br />part of the Conditional Use Permit process. <br />Anderst inquired what typically is required with a conditional use permit. <br />Mayor Jabbour stated the requirements vary from property to property and are undetermined at <br />this time. Mayor Jabbour stated there still is an issue with the live entertainment that will need to <br />be further addressed. <br />Kelley stated the kitchen may need to be brought up to code and other items such as <br />lighting, signage, parking, and hours of operation will need to be reviewed. Kelley expressed <br />concern that he is being requested to approve this application without those questions being <br />answered. <br />Flint commented that the City Council is not approving the conditional use permit at this time <br />but is merely allowing the Applicant to proceed forward with the remodeling. <br />Mayor Jabbour stated the City Council in his view will not be able to den\- the Applicant the <br />right to continue to operate as he was in the past, but that any expansion of use will need to be <br />reviewed. Jabbour stated the issuance of a building permit has triggered a number of <br />requirements which will need to be addressed. <br />Kelley stated the amount of parking required for this business differs from the photo business • <br />that used to exist at this location. <br />Page 8 <br />
