The Planning Commission will review this conditional use permit <br />application at their next meeting. The Applicant has requested that he be allowed to proceed with <br />the remodeling and expansion. City Staff would request a letter in writing from the Applicant <br />indicating that all work is done at the owner's risk at this point since a conditional use permit is <br />required. <br />Weinberger stated the Applicant is requesting the City Council approve the continued remodeling <br />of the Narrows Saloon prior to the August 21" conditional use permit review and prior to the <br />issuance of the conditional use permit. <br />Anderst stated he obtained a demolition permit from the City to tear a concrete wall out and erect <br />a beam. Anderst stated he submitted architectural drawings to the City and obtained a building <br />permit. Anderst stated he proceeded with the remodeling and requested a footings inspection <br />and was told at that time that he needed to appear before the City Council. Anderst stated he was <br />informed by the building inspector that he did not notice the new footings at the time lie <br />reviewed the plans. <br />Mayor Jabbour stated it was his recollection that at the time the Applicant approached the City <br />for a liquor license, he had indicated lie wanted to remodel the structure. Jabbour stated the issue <br />relating to live music will be part of the conditional use permit, but the restaurant and bar license <br />has been approved. <br />• Weinberger stated the Applicant is expanding into the vacant Minnetonka Photo space, and <br />technically a conditional use permit is required. Weinberger stated any building permits to expand <br />the size of this building, requires City Council approval as part of a commercial site plan review, <br />which is part of the conditional use permit process. <br />Mayor Jabbour inquired why the owner is proceeding at his own risk since the City has previously <br />granted a liquor license based on the existing plan and also a building permit. <br />Weinberger stated the issue relates to the live entertainment. <br />Kelley stated in his view the City has errored by not realizing the Applicant would be expanding <br />the use of his business, which requires a conditional use permit, without having a commercial <br />site plan done first. Kellcy stated City Staff should have realized at the time of the request for a <br />demolition permit that the business was being expanded and that a site plan review was required <br />as well as a conditional use permit to do that. <br />Mayor Jabbour pointed out the Applicant is attempting to .work with the City on this matter and <br />that hopefully a mutual agreement can be reached. <br />Kelley indicated as part of a commercial site plan other factors cone into play, such as lighting, <br />signage, and parking, which the Applicant should be aware of Kelley stated he has concerns <br />that the City Council gives the okay to proceed forward with the remodeling .without these other <br />issues being addressed. Kelley commented in his view it is not proper for the City Council to <br />proceed forward with this application without a site plan review and conditional use permit <br />review. <br />Page 7 <br />
