T <br /> d - Cit o� ORONO <br /> � <br /> • � RESOLUTION OF THE CITY COUNCIL <br /> � NO. 2492 <br /> • - • • . <br /> D) The applicants were granted a variance in 1976 to construct � <br /> major additions to the house, which were approved at that time <br /> conditioned upon removal of a 20'x20' concrete patio on the lake- <br /> shore side of the house. That patio has never been removed. The <br /> applicants' hardship in needing that patio or a portion of it <br /> relates to ice build-up and winter access to the house in <br /> conjunction with his existing wooden deck. The existing concrete <br /> slab is in three separate units, and the southerly portion can <br /> easily be removed without causing damage to the remaining <br /> portion. This will result in a 146 s.f. reduction in hardcover � <br /> in the 0-75' zone. <br /> E) Although the total hardcover on the property �is less square <br /> footage than would be allowed within the 75-250' zone, the fact <br /> that a significant portion of that hardcover is in the 0-75' zone. <br /> is ample justification for reduction of 0-75 ' hardcover, <br /> • especially in this case where that hardcover was previously <br /> , required to be removed. <br /> . 4. The City Council has considered this .application including the <br /> findings and recommendations of the Planning Commission, reports by ' <br /> City staff, comments by the app licants and the effect of the proposed <br /> variance on the health, safety and welfare of the community. . <br /> 5. The City Council finds that the conditions existing on this <br /> property are peculiar to it and do not apply generally to other <br /> property in this zoning district; that granting the variance would not <br /> adversely affect traffic conditions, light, air nor pose a fire hazard <br /> or other danger to neighboring property; would not merely serve as a <br /> convenience to the app licants, but is necessary to alleviate a demon- <br /> strable hardship or difficulty; is necessary to preserve a substantial <br /> property right of the applicants; and would �be in keeping with the <br /> spirit and intent of the Zoning Code and Comprehensive Plan of the <br /> City. <br /> CONCI�IISIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the findings noted above, the Orono <br /> City Council hereby grants a variance per Municipal Zoning Code Section <br /> 10.23, Subdivision 6 (B) to permit the construction of a sunroom addition <br /> located 19' from the street lot line where a 50' street yard setback is <br /> • normal ly required, and grants a variance to Section 10.22, Subdivision 2 to <br /> allow additional structural hardcover on the property when a significant <br /> portion of the existing hardcover is in the 0-75' lakeshore setback zone, <br /> subject to the following conditions: <br /> Page 2 of 4 <br />
