HILBELINR AND J. VOGT <br /> FILS NO. ].201 <br /> WHEItEAS, Michael J. Hilbelink and John Vogt (hereinafter <br /> "the appli:Cants" ) on September 1, 1987 filed a formal subdivision <br /> application with the City for a division of ele,ven lots of a property <br /> legally described as follows: <br /> The Northeast 1/4 of the Southeast 1/4 of Section 33, Township <br /> 118, Range 23, Hennepin County, Minnesota, except that part taken <br /> for Railroad (hereinafter "the property" ) and; <br /> WHER$AS, after due published and mailed notice in accordance <br /> with Minnesota Statues 462:358 et. seq. and the City of Orono Zoning <br /> and Platting Codes, the Orono Planning Commission held public hearings <br /> on September 21, 1987 and December 21, 1987 , at which times all <br /> persons desiring to be heard concerning this application were given <br /> the opportunity to speak thereon; and <br /> • WH$R$AS, at their regular meeting held on January 11, 1988, <br /> the Orono City Council considered the subdivision application of the <br /> applicants, noting the following findings of fact: <br /> l. The property is located within the RR-1B Single Family Rural <br /> Residential Zoning District requiring a minimum of 2 acres of <br /> contiguous dry buildable land within each newly created lot. <br /> , 2. The property contains a total of approximately 35.10 acres. <br /> 29. 8 acres are considered dry buildable lands. <br /> 3: The proposed plat contains eleven lots each exceeding the 2.0 <br /> acre minimum lot area requirement: <br /> 4: All eleven lots shall be served by private roads. The <br /> location and curb cut for the private road that intersects at Old � <br /> Crystal Bay Road have been approved by the City Engineer. <br /> 5. All lots meet the required 200 feet width adjacent to the road <br /> and at the rear of the front yard setback line. <br /> � 6: A single family residence can be constructed on all proposed <br /> lots without the need for any variances: <br /> .
