RESOLUTION OF THE CITY COUNCIL <br /> ���``°" 2084 <br /> � NO. <br /> _*�., <br /> • - • • . <br /> NOW, THER$FORE, BE IT RESOLUED that based upon either one or <br /> more of the findings noted above, the City Council of the City of <br /> Orono hereby approves the preliminary plat of a lot line rearrangement <br /> per drawings by Mark S. Gronberg dated 12/19/84 subject to the <br /> folYowing conditions: <br /> 1. Thomas J. Bernier, owner of Lot 2 , shall execute a <br /> Developer's Agreement and post a letter of credit to assure that <br /> illegal access stairs on Lot 2 Casco Cove are altered to meet <br /> approved standards of City for lake access stairs by ApriY 30, <br /> 1987. In addition, the City wilY ask that Thomas J. Bernier <br /> execute a Hold Harmless Agreement to assure that if municipal <br /> utility lines sustain any damage as a result of the Iakeshore <br /> land alteration on Lot 2 that Bernier W�ii assume complete <br /> financiaY responsibility for repair of lines. <br /> 2. Douglas E. KYint, owner of Lot l, shall execute a Developer's <br /> • Agreement and post a letter of credit to assure that disturbed <br /> lakeshore yard within Lot 1 and adjacent neighbor's yard are <br /> graded and ground cover restored and damaged trees trimmed by <br /> Apri 1 30, 1987. <br /> 3. Thomas J. Bernier and Gary A. Barr shall not re-install docks <br /> on Lots 2 and 3 until final plat is approved by the City of <br /> Orono. Bernier must obtain a building permit for installation of <br /> dock on Lot 2. <br /> The following list of directives must be fulfilled and <br /> requested submittals must be submitted to the Zoning Administrator two <br /> weeks prior to the regularl.y scheduled Council meeting on the second <br /> or fourth Monday of the month: <br /> A) Record PYat Drawings in the form of two (2) mylar copies, <br /> (three (3 ) mylars if torrens property) and one (1) additional <br /> copy reduced to 1"=200 ' . <br /> Drawi:ng to include: <br /> 1. Lot lines platted per preliminary survey per drawing by <br /> Mark S. Gronberg dated 12/19/84. <br /> 2. Shoreline of Lake Minnetonka. <br /> • 3. Dedication of "Utility Easements" 20 feet wide over <br /> municipal sewer and water lines as shown on that same survey <br /> dated 12/19/84. <br /> Page 2 of 3 <br />
