• <br />• <br />MINUTES OF THE ORONO PLANNING COMMISSION MEETING <br />HELD APRIL 19, 1993 <br />ZONING FILE #1811 — CONT. <br />Mrs. Bielke stated when they purchased their property, the variance <br />had not yet been approved. She noted they along with Remien opposed <br />the first variance request, prior to Remien purchasing the parcel. <br />She read a letter from their attorney presenting reasons for <br />denial. She referred to Section 10.08 dealing with variance <br />approval regarding the health, safety and welfare of the public, <br />and suggested the erosion problem in this area should make the lot <br />unbuildable as it would be adding to the problem and would be <br />detrimental to the neighborhood. She added they did have their <br />house Iisted prior to this situation, but felt this may depreciate <br />the value of their home. She felt this request does not meet the <br />criteria for approval, and suggested this lot be combined with Lot <br />19. <br />Mr. Nisiedlak, potential buyer of Lot 18, advised that the house <br />will be built back from the Lakeshore and will not add to the <br />erosion problem. He felt the house he would build would not lower <br />the standards of the neighborhood, and said he would be wiIIIng to <br />supply the Bielkes with plans to present to potential purchasers <br />of their property. <br />Weckman reviewed that the sewer connection stub for Lots 16 and 17 <br />is located within the boundary of Lot 18. <br />Mrs. Bielke stated it is 3.5' within the boundary of Lot 18, and <br />added they were unaware of that situation when they purchased their <br />property. She said the records of the City indicate that Lot 18 was <br />unbuildable and that is why the sewer line was placed within its <br />boundary. <br />Mabusth disagreed, and stated the three parcels Lots 16, 17 and 18 <br />were owned in common at the time of installation of that pipe, and <br />that is why it was placed on Lot 18. <br />Mrs. Bielke read from memo from Gaffron to the City Council dated <br />December 1985 which states, "they do not anticipate that Lot 18 <br />would become buildable ". <br />Bellows indicated that statement means the BIeIkes need a new stub <br />to their property. She felt hard pressed to deny the request <br />because of past approvals. She noted the property has changed hands <br />several times as a buildable lot, and this request would not set <br />a new precedent in the neighborhood. <br />8 <br />
