• <br />MINUTES OF THE ORONO PLANNING COMMISSION MEETING <br />HELD APRIL 19, 1993 <br />ZONING FILE #1811 - CONT. <br />It was moved by Bellows, seconded by Cohen, to recommend approval <br />of Application #1811 for C. Jack Remien, 3237 Casco Circle, <br />approving lot area and width variances to construct a new <br />residence. <br />Johnson said he respects the position of all involved parties, and <br />could not support the request as he felt the property should be <br />combined with Lot 19 as one condition for approval is that no <br />additional land is available. <br />Bellows felt that was an incorrect interpretation of the code. <br />Mabusth rioted the code specifically states that substandard lots, <br />whether in single separate or commonly owned, are to be judged on <br />their own merits. The finding that no additional land is available <br />was validated during the variance review because at the time the <br />lot was not owned in common with adjacent lots. <br />• Peterson felt approval requires too many variances. <br />Schroeder questioned why the neighbors did not buy the parcel. <br />Mrs. B i e I ke stated they were unaware that i t was for sa I e unt i I too <br />late. <br />Jay and Gay R i chards, 3243 Casco C i rc I e, stated they were g i ven the <br />impression that Remien purchased the parcel for use in conjunction <br />with Lot 19. He said the only reason why the City approved the <br />variance in the past was because it had been taxed as buildable, <br />and an attorney owned it at the time and the City did not want to <br />be brought into legal action. <br />Bellows felt that issue was not pertinent. <br />Vote: Ayes 3, nays 2. Johnson and Peterson voted nay. <br />( #11) #1812 THOMAS PATRICK GOODYEAR, <br />712 TONKAWA ROAD <br />VARIANCES - PUBLIC HEARING 8:40 - 9:05 P.M. <br />The Affidavit of Publication and Certificate of Mailing were noted. <br />Mr. Goodyear was present. <br />Mabusth reviewed the applicants request to add a second story to <br />• the existing residence, including the addition of a 2'+ expansion <br />into the right side yard to square off the foundation.
