She noted that the court needs to <br />be resurfaced, but basically is in good condition. Current owners <br />and future owners have significant interest in the tennis court. <br />Peterson asked if the owners have a use for the detached garage. <br />Howell stated it is used for lawn equipment and is in reasonably <br />good shape. <br />Mabusth stated that during a conversation with Jack Taylor, the <br />applicant's attorney, she explained the allowed maintenance to non- <br />conforming structures. She felt that resurfacing was normal <br />maintenance <br />Bellows suggested that in exchange for the drive to be allowed to <br />remain too close to the wetland, the non - conforming structures <br />should be removed. <br />• It was moved by Bellows, seconded by Cohen, to recommend approval <br />for Application #1743 for Albert Hanser, 1685 Fox Street, for <br />preliminary subdivision approval, subject to conditions of staff <br />recommendation #1 through #7, with the exception that #6 allow the <br />guest house only to remain under a conditional use permit, and the <br />detached garage and tennis court be removed. The proposed use is an ice <br />hockey arena and outdoor rink at the northeast section of the <br />School's property. The School has already purchased the two <br />eastern parcels and is in the process of purchasing an additional <br />parcel this year and the final parcel in 1993. Once the purchase <br />is complete by the School District, the City has agreed to vacate <br />the road outlot and all easements that were shown.
