MINUTES OF THE <br /> ORONO PLANNING COMMISSION MEETING <br /> Monday, November 17, 2003 <br /> 6:00 o'clock p.m. <br /> (#11) #03-2961 NINA WILDMAN, 745 SPRING HILL ROAD, PRELIMINARY <br /> PLAT, Continued <br /> Gaffron explained that this is a proposed 3-lot residential plat of property located on the <br /> southwest shore of Lydiard Lake. The proposal includes: <br /> - keeping the existing residence, guesthouse and tennis court within a 6.3 acre <br /> lakeshore parcel (Lot 1); <br /> - development of a new 11.5-acre lakeshore building site for construction of one new <br /> home in the near future (Lot 2); <br /> - creation of a 5.8 acre non-lakeshore parcel to be acquired by the adjacent property <br /> owner, has potential for future residential development (Lot 3). <br /> - creation of an outlot for a private loop cul-de-sac driveway primarily serving Lot 2 <br /> but also functioning as an emergency vehicle turnaround <br /> Gaffron continued, stating that the applicant proposes to construct a new home southeast of <br /> the existing residence. The property is zoned for 2-acre lots and is not in the Metropolitan <br /> Urban Service Area, and therefore will continue to be served by septic systems and wells. <br /> The site is mostly open fields and abuts the DNR's Wood Rill Scientific and Natural Area <br /> to the immediate south. Access to the property is via a long, narrow private road that <br /> exists pursuant to a variety of easements between property owners. The property itself <br /> does not abut a public road. The private road currently serves 4 homes, and will serve 5 <br /> homes (and a potential 6th)upon completion of the subdivision. While the applicant does <br /> not want to subdivide to the highest possible density under the 2-acre zoning, future <br /> subdivision potential exists. Staff has worked with the applicant and her consultants to <br /> ensure that the ability to meet City codes for future subdivisions is not compromised by the <br /> current proposal. <br /> Gaffron acknowledged that road access is perhaps the single greatest concern identified by <br /> Staff regarding this subdivision, relative to the following site conditions: <br /> 1. The property does not abut a public road, but is accessed via a private <br /> road/driveway within a cartway established in 1882 from what today are properties owned <br /> by Winston and Hawn, and within a private easement over the adjoining Winston property. <br /> The cartway is not maintained by the City. Its legal status is somewhat unclear to staff and <br /> this will require some review by an attorney... <br /> 2. The private driveway/road serves 4 existing homes, and will serve 5 or 6 homes as <br /> a result of the subdivision. <br /> 3. The private driveway/road does not end in a cul-de-sac, but rather branches off to <br /> individual driveways which each have a driveway loop near the residences. <br /> PAGE 22 of 41 <br />
