VOTE: Ayes 7,Nays 0. <br /> NEW BUSINESS, CONTINUED <br /> (#9) #02-2780 OTTEN BROTHERS NURSERY,2350 WEST WAYZATA BOULEVARD, <br /> AMENDMENT TO PUD#1, 11:51 P.M.- 12:30 A.M. <br /> Cliff Otten,Applicant and President of Otten Brothers, along with Nursery Manager John O'Reilly, were <br /> present. <br /> Weinberger explained that the applicant has requested an application to amend PUD Agreement#1 that <br /> was executed with the approval of the East Willow Woods in 1990. The proposed amendment is to <br /> permit a restaurant use on the property and to lift the exception clause within the PUD agreement that <br /> limits the amount of B-1 permitted uses on the property. <br /> Weinberger reported that Otten Bros. has recently opened a self-contained concession stand,known as <br /> "Daisy Diner"to be located within the building and permanent greenhouse. Daisy Diner has been in <br /> operation for about a month and operating under a Transient Merchant License that allows it to remain <br /> open until July 2, 2002. <br /> The property is currently zoned PUD with B-6 as the underlying zoning districts. Weinberger maintained <br /> that the permitted uses are those uses listed as permitted in the B-6 district and those listed in the B-1, <br /> except those items as listed on page 1 of Weinberger's memo and page 2 of the PUD Agreement. <br /> Weinberger pointed out that other issues exist. One issue is that there are no standards that limit the types <br /> of equipment that can be used on the property. While the zoning ordinances regulate uses,they do not <br /> regulate the types of equipment that would be allowed with a particular use,nor are noise ordinances <br /> adequately enforced. <br /> PAGE 24 <br />
