STEPHENSON,IH., 1850 FOX RIDGE ROAD,CONDITIONAL USE <br /> PERMIT,7:30 p.m.—7:58 p.m. <br /> Revis Stephenson,Applicant,was present. <br /> Weinberger stated the Applicant has requested a conditional use permit to permit land alteration over <br /> 500 cubic yards on the property located at 1850 Fox Ridge Road. The project would consist of clear <br /> cutting the slope and depositing approximately 3,280 cubic yards of fill. The purpose of the project is <br /> to create a gradual slope rather than the existing steep drop from the immediate back yard of the <br /> house. The source of the fill is from the Orono Woods apartment building located at the northwest <br /> corner of Highway 12 and Brown Road. <br /> Weinberger stated a conditional use permit is required for land alteration greater than 500 cubic yards. <br /> The slope on this lot is not located within a shoreland area. Weinberger stated some existing less <br /> mature trees would be removed within the intent of the Applicant to replant once the fill is placed on <br /> the hillside. The Applicant is also proposing to plant additional trees and natural grasses. Weinberger <br /> stated it is not the intent of the Applicant to maintain this area as lawn but as a natural area. <br /> Weinberger stated approximately 300 truck loads of fill will be delivered to the site. The source of the <br /> fill is from the senior apartment building site located at Highway 12 and Brown Road. The City <br /> Engineer has expressed some concerns about the potential damage to Fox Ridge Road, which is a City <br /> street, given the number of truck loads that will be traveling over this road. Staff is recommending the <br /> property owner provide some type of financial guarantee that could be used to correct any damage <br /> caused by the contractors' activities. <br /> Weinberger stated a utility easement is located through the property, which was granted in the 1970s as <br /> part of a Metropolitan Council project. The sewer main line was never constructed and portions of the <br /> original easement located over the 20 acre property north of the Luce Line Trail was vacated years ago <br /> when it was determined the line would not be constructed. The easement located across this property <br /> and other lots in the Fox Ridge neighborhood has not been vacated. Staff is requesting input from the <br /> Metropolitan Council on the future use of this easement and whether it can be vacated. <br /> Staff is recommending approval of the application based on the following conditions: <br /> 1. A determination is made by all agencies with rights to the utility easement that 12 feet of fill can <br /> be located over the easement. <br /> 2. A letter should be submitted by the property owner indicating that two silt fences would be <br /> installed to protect the existing wetland, and that the silt fence would be installed prior to any tree <br /> removal or land alteration. <br /> PAGE 7 <br />
