VOTE: Ayes 7,Nays 0. <br /> (#3)#01-2693 DAVID AND MARYANN MAISER,2700 SHADYWOOD ROAD,VARIANCES, <br /> 6:48 p.m.—6:56 p.m. <br /> David Maiser,Applicant,was present. <br /> Weinberger stated this application was tabled at the July 16 Planning Commission meeting to allow the <br /> Applicant time to revise his plans. The Applicant is requesting hardcover variances and a variance to <br /> the side yard adjacent to street setback to permit a garage addition,deck replacement, and the addition <br /> of a deck and patio. The Applicant is proposing replacement of an attached 9' x 28' deck within 75 feet <br /> of the lakeshore, a 23' x 28.8' garage addition encroaching within 75 feet of the lakeshore, and a 12' x <br /> 20' porch with an attached 12' x 11' deck within 75 feet of the lakeshore. The proposed garage addition <br /> will not increase hardcover since it is being built over existing hard surface where the previous parking <br /> area was located. <br /> The Planning Commission indicated the garage addition and replacement of the deck in equal dimension <br /> was acceptable. The issues were in relation to the proposed porch addition. The Applicant has revised <br /> the plan slightly in order to address some of the concerns raised by the Planning Commission. <br /> Weinberger stated the existing detached garage would be utilized as a workshop and storage area,with <br /> the driveway leading to the detached garage being removed. The green house presently attached to the <br /> garage will be removed as well as the sidewalk and porch area by the garage. <br /> Weinberger indicated a variance is required for the three-season porch located off the end of the house <br /> since it will be within 75 feet of the lakeshore. <br /> Staff recommends approval of the variance to allow the deck to be replaced within 75 feet of the <br /> lakeshore. The Planning Commission had indicated at its previous meeting that the porch and deck <br /> addition would be acceptable if the deck is removed from within the 75 foot setback and removal of <br /> hardcover within the 75-250' setback would reduce hardcover to less than 25 percent. <br /> Maiser stated the residence is basically located on the 35 foot setback,with a 12 to 18 inch <br /> encroachment by the southwest corner of the house. <br /> There were no public comments regarding this application. <br /> Hawn commented this is a better proposal than what was previously submitted. <br /> Mabusth noted this plan does address every issue raised by the Planning Commission. <br /> Smith suggested hardcover be limited in the future on this property. <br /> PAGE 3 <br />
