The house was constructed in 1970 and conformed to the setback <br /> requirements. It was made non-confonning by the rezoning of the property <br /> in 1975 to RR-1B. <br /> b. The new entry porch will allow the existing entry porch to be converted <br /> into an entry room. The enlarged entry will eliminate the current unsafe <br /> and undersized entry and a11ow a direct connection between the living <br /> space and the attached garage. <br /> c. The enclosure of the existing porch and the addition of a new parch as well <br /> as the chan�es in the roofline will allow the owners to make a simple <br /> update their residence that will improve its livability while enhancing the <br /> neighborhood. <br /> 4. The City Counci] has considered this application including the findin�s and <br /> recommendation of the Planning Commission, reports by City staff, conzments <br /> by the applicants and the public, and the effect of the proposed variance on the <br /> health, safety and welfare of the community. <br /> 5. The City Council finds that the conditions existing on this property are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting tlle variance would not adversely affect traffic conditions, light, air <br /> nor pose a fire hazard or other danger to nei�hboring property; would not <br /> merely serve as a convenience to the Owners but are necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a substantial <br /> property right of the Owners; and would be in keeping with tl�e spirit and <br /> intent of the Zoning Code and Comprehensive Plan of the City. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon the above findings, the Orono City Council hereby ��-ants a variance to Orono <br /> Code Section 78-420 to allow an open entry porch with a 36 foot setback from Cygnet Place <br /> when a 40 foot setback exists and a 50 foot setback is required and to allow changes to the <br /> roof lines over the existing entry porch and portion of the garage within the �0 foot setbacks <br /> from Cygnet Place and Watertown Road, subject to the following conditions: <br /> Page 2 of 4 <br />
