The property is a year-round residence that has no garage. It is a hardship <br /> to not have a garage. <br /> b. An attached garage would have to be located well forward of the other <br /> houses on the block and thus be out of character with the surrounding area. <br /> c. Because of the location of the house the setback variances are necessary to <br /> provide vehicle access to the garage and allow drainage to flow between <br /> the house and driveway. <br /> d. The applicant proposes to remove hardcover, including a shed and portion <br /> of the house. <br /> 4. The City Council has considered this application including the findings and <br /> recommendation of the Planning Commission, reports by City staff, comments <br /> by the applicants and the public, and the effect of the proposed variances on <br /> the health, safety and welfare of the community. <br /> 5. The City Council finds that the conditions existing on this property are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variances would not adversely affect traffic conditions, light, air <br /> nor pose a fire hazard or other danger to neighboring property; would not <br /> merely serve as a convenience to the Owner but necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a substantial <br /> property right of the Owner; and would be in keeping with the spirit and intent <br /> of the Zoning Code and Comprehensive Plan of the City. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon the above findings, the Orono City Council hereby grants variances to Orono <br /> Code Sections 78-1288 to have 39.3 percent hardcover in the 500 to 100 foot zone when the <br /> maximum allowed is 35 percent and to Orono Code Section 78-1511 to allow a detached <br /> garage five feet from the south and east property lines when 10-foot setbacks are required, <br /> subject to the following conditions: <br /> Page 2 of 4 <br />
