RESOLUTION OF THE CITY COUNCIL <br />NO. 6602 <br />WHEREAS, at meetings held on February 8, March 14, and April 11, 2016, the <br />City Council reviewed the application and the recommendations of the Planning Commission and <br />City staff; and <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of Orono, Minnesota <br />hereby approves the requested variances and CUP as described above based on one or more of <br />the following findings of fact concerning the Property: <br />FINDINGS OF FACT: <br />1. This application was reviewed as Zoning File #16-3803. The analysis contained within <br />staff memos and the exhibits attached to the aforesaid memos, all minutes from the above <br />mentioned meetings, and any and all other materials distributed at these meetings are <br />hereby incorporated by reference. <br />2. The Property is located in the LR -1A Zoning District. <br />3. The Property contains 1.6 acres in area and has a defined lot width of 133 feet at the <br />OHWL and 133 feet at the 75 -foot setback. <br />4. The Property is within Tier 1 and hardcover is limited to 25% according to the Stormwater <br />Quality Overlay District. <br />5. The Property is currently vacant; the Applicants intend to construct a new principal <br />structure on the Property. <br />6. Applicants have applied for the following variances: <br />a. Lot Area Variance; <br />b. Lot Width Variance; and <br />c. Side Street Setback Variance. <br />7. The Applicants intend to export approximately 2,000 cubic yards of material from the site <br />to accomplish the approved grading plan. <br />8. In considering this application for variances and CUP, the Council has considered the <br />advice and recommendation of the Planning Commission and the effect of the proposed <br />variances and CUP upon the health, safety and welfare of the community, existing and <br />anticipated traffic conditions, light and air, danger of fire, risk to the public safety, and the <br />effect on values of property in the surrounding area. <br />
