CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 66n 2 <br />A RESOLUTION <br />APPROVING VARIANCES FROM <br />MUNICIPAL ZONING CODE SECTION 78-305 <br />AND APPROVING A CONDITIONAL USE PERMIT PURSUANT <br />TO MUNICIPAL ZONING CODE SECTIONS 78-966 $ 78-967 <br />FILE NO. 16-3803 <br />WHEREAS, on December 16, 2015, Tashitaa Tashoo Tufaa and Nediyo Gemechu <br />Sado, husband and wife (hereinafter the "Applicants"), are the owners of the property located at <br />1830 Shoreline Drive and legally described as: <br />Lots 1 and 1A, Auditor's Subdivision No. 356, Hennepin County, Minnesota <br />(hereinafter the "Property"); <br />WHEREAS, the Applicants have made application to the City of Orono for a <br />variance to Orono Municipal Zoning Code Section 78-305 to allow construction of a new home on <br />a property 1.6 acres in area and having 133 feet in width where 2.0 acres and 200 feet of width <br />are required; and <br />WHEREAS, the Applicants have made application to the City of Orono for a <br />variance to Orono Municipal Zoning Code Section 78-305 to allow construction of a new home <br />located 34.8 feet from the side street property line where a 50 -foot setback is normally required; <br />and <br />WHEREAS, the Applicants have made application to the City of Orono for a <br />conditional use permit (hereinafter the "CUP") pursuant to Orono Municipal Zoning Code Sections <br />78-966 and 78-967 to permit the export of approximately 2,000 cubic yards of earth material from <br />the site; and <br />WHEREAS, on January 19, 2016, after published and mailed notice in accordance <br />with Minnesota Statutes and the City Code, the City Council held a public hearing, at which time <br />all persons desiring to be heard concerning this application were given the opportunity to speak <br />thereon; and <br />WHEREAS, on January 19, 2016, the Planning Commission recommended <br />approval of the variances and CUP; and <br />
